Prohibition of supply to minors

Pursuant to Section 10 of the Youth Protection Act (Jugendschutzgesetz, JuSchG), the supply of nicotine-containing products, nicotine-free vaping products (e-cigarettes, vapes) and related products to children and adolescents under 18 years of age is expressly prohibited. This also applies to mail-order trade.

Section 10 (4) JuSchG expressly extends to nicotine-free products in which liquid is vaporised by an electronic heating element and the resulting aerosols are inhaled – regardless of the active ingredient contained.

Meshflash is legally obliged to verify the age of its customers. For mail-order purchases, age verification is carried out through corresponding procedures (e.g. PostIdent, age verification by the delivery agent). Delivery without successful age verification is not possible.

Applicable legal situation for HHZ Vapes

The Meshflash HHZ Vapes are subject to a complex legal framework in Germany consisting of several laws and regulations.

Tobacco Products Act (TabErzG)

The Act on Tobacco Products and Related Products (TabErzG) strictly regulates e-cigarettes and vapes. It applies to all vaping products – including those without nicotine and without tobacco. Particularly relevant are Section 22 TabErzG (prohibition of radio and television advertising), Section 20 TabErzG (prohibition of supply to minors, including in mail-order trade) as well as the obligation to provide health warnings in accordance with EU Directive 2014/40/EU on the packaging.

New Psychoactive Substances Act (NpSG)

The NpSG prohibits the manufacture, placing on the market, advertising and possession of new psychoactive substances. HHC (hexahydrocannabinol) may fall under this act depending on the official classification.

Note: The classification of HHC under the NpSG is the subject of ongoing official and legal reviews in Germany. Meshflash continuously stays informed about current developments and adjusts its range accordingly.

Consumer Cannabis Act (KonsG)

The Act on the Controlled Handling of Cannabis (KonsG) stipulates that any advertising of the intoxicating effect of cannabinoids is prohibited. The THC limit for cannabis products is 0.3%.

Youth Protection Act (JuSchG)

The JuSchG defines children as persons under 14 years of age, adolescents as persons between 14 and 17 years of age, and adults as persons aged 18 and over. The sale of Meshflash products takes place exclusively to persons aged 18 and over.

Mandatory information on Meshflash HHZ Vape products

In accordance with the TabErzG and the relevant EU directives, the Meshflash HHZ Vapes contain the following mandatory information on the packaging: complete list of ingredients with quantities, statement of nicotine-freeness (0 mg nicotine), health warnings in accordance with EU Directive 2014/40, name and full address of the manufacturer or importer, visible minor-protection notice on the front, capacity in ml as well as a guideline value for the number of puffs, battery specification and charging type for devices.

Prohibited advertising practices

Meshflash expressly undertakes to refrain from the following statements and practices: healing claims such as "heals", "treats", "relieves [illness]", "fights" or "cures"; any reference to illness (cancer, epilepsy, pain, anxiety, depression, insomnia); the advertising of intoxication, a high or psychoactive effect – not even indirectly; claims of health benefits over other inhalation products without an approved scientific basis; "harm reduction" marketing without a robust scientific basis; depictions of minors or child-appropriate imagery; testimonials from doctors or alternative practitioners regarding product-related effects; advertising on platforms with a predominantly young audience as well as misleading naturalness claims for synthetic aromas or ingredients.

Our communication standards

All Meshflash product descriptions and advertising materials meet the following requirements: neutral product descriptions of flavour, extraction, origin and variety; quality statements with source references (e.g. accredited EU laboratory analysis, certified ingredients); information on the cannabinoid profile without effect promises; age-appropriate imagery and tonality aimed at adults as well as correct labelling of advertising and sponsored content on social media.

Age verification in mail-order trade

Pursuant to Section 10 (3) JuSchG, vapes and related products may not be supplied to minors in mail-order trade. Meshflash implements this through an age query in the ordering process (confirmation of legal age), age verification by the delivery agent (parcels are only handed over upon presentation of a valid identity document) as well as through the instruction not to tolerate supply to substitute recipients who are visibly minors.

Product category & legal status of HHC

HHC (hexahydrocannabinol) is a semi-synthetic cannabinoid obtained through the hydrogenation of THC or CBD. Unlike CBD, the legal status of HHC in Germany is not conclusively clarified. A classification under the NpSG is officially possible and is being reviewed. The advertising of a psychoactive effect is prohibited (KonsG, NpSG), the sale to minors is prohibited (JuSchG, TabErzG), radio advertising is prohibited (Section 22 TabErzG), healing claims are prohibited (HWG) and health claims are only permitted in EFSA-listed form (HCVO).

Legal notice: HHC has been objected to several times by German authorities. Meshflash continuously stays informed about official decisions and rulings. The products are distributed in accordance with the law applicable at the time of sale.
