Ban on supply to minors

Under § 10 of the German Youth Protection Act (JuSchG), tobacco products and other nicotine-containing products may not be supplied to children and young people. This also applies to distance selling.

Under § 10 (4) JuSchG, this ban expressly also applies to nicotine-free products such as e-cigarettes and vapes in which a liquid is vaporised by an electronic heating element.

Meshflash sells all products exclusively to persons aged 18 and over.

Legal framework

Several laws and regulations apply to our products in Germany. The most important ones at a glance:

Youth Protection Act (JuSchG)

The JuSchG defines children as persons under 14 years of age and young people as persons aged 14 to 17. Meshflash sells exclusively to persons aged 18 and over.

Tobacco Products Act (TabakerzG)

The Tobacco Products Act regulates tobacco products and related products such as e-cigarettes and refill containers, including advertising, labelling and warnings. It is based on EU Directive 2014/40/EU.

Consumer Cannabis Act (KCanG) and Medical Cannabis Act (MedCanG)

Since 1 April 2024, the KCanG and the MedCanG have governed the handling of cannabis. Advertising and sponsorship for cannabis are prohibited under the KCanG. Under KCanG § 1 No. 9, industrial hemp may contain no more than 0.3 % THC.

New Psychoactive Substances Act (NpSG)

The NpSG prohibits the manufacture, trade and placing on the market of the substances listed in its annex. HHC (hexahydrocannabinol) has been listed in the annex to the NpSG since 27 June 2024. Meshflash therefore does not stock any HHC products.

HHZ is currently listed neither in the BtMG nor in the annex to the NpSG (as of August 2026). The legal situation for cannabinoids may change. We adapt our range to the current situation at all times.

Other regulations

HWG, Therapeutic Products Advertising Act: ban on promises of healing and references to diseases.

HCVO, Health Claims Regulation (EC) No 1924/2006: health claims only in authorised form.

UWG, Act against Unfair Competition: ban on misleading advertising.

How we communicate

We make no statements about effects, no promises of healing and no references to diseases. Our product descriptions are limited to aroma, variety, fill quantity and ingredients. Our imagery and tone are aimed exclusively at adults. We label advertising and sponsored content as such.

Distance selling

Under § 10 (3) JuSchG, vapes and related products may not be supplied to minors through distance selling. By placing your order, you confirm that you are at least 18 years old.
